Terms of Service

These terms apply to personalised digital-invitation services ordered from Naqsh Digital Invites.

1. About Naqsh and these Terms

Naqsh Digital Invites is operated by Mohammed Musaddiq, trading as Naqsh Digital Invites, India. In these Terms, “Naqsh”, “we”, “us” and “our” refer to that business, and “you” refers to the customer making the booking.

These Terms apply together with our Privacy Notice, Shipping & Delivery Policy and Cancellation and Refund Policy. Mandatory rights available under applicable consumer law continue to apply.

2. The invitation service

The standard service is a personalised digital invitation based on the Naqsh theme selected at booking. Its exact content, features and price are those shown at checkout or in a written quotation accepted before work begins.

Personalisation normally means adapting the selected theme with the customer’s names, photographs, event information, wording and other agreed details. New features, a different theme, extensive redesigns or other work outside the included scope may require additional time and a separate written quotation. We will not begin chargeable extra work without informing you.

3. Booking and payment

A standard online booking becomes confirmed when Razorpay reports that the full checkout amount has been successfully captured. If Naqsh offers a different payment method or a complimentary booking, confirmation occurs when Naqsh records that booking as confirmed.

The checkout total includes the selected invitation and any add-ons shown in the order summary. A payment receipt or booking confirmation does not transfer ownership of Naqsh templates, source code or other underlying intellectual property.

4. Customer details and supplied content

You are responsible for providing accurate names, spelling, dates, timings, venue information, map links, wording, photographs, music or media references and other instructions, and for reviewing each preview carefully.

You retain any rights you hold in original content you supply. You confirm that you have the authority and any permissions or licences reasonably required for Naqsh to use the supplied photographs, music, text, logos, personal details and other materials for your invitation. You must not submit unlawful, infringing, misleading or harmful material.

You grant Naqsh a limited, non-exclusive permission to store, reproduce, adapt and display supplied content only as reasonably needed to create, revise, host, support and deliver the booked service, and for any separate portfolio use you expressly approve. This permission does not transfer ownership of your content to Naqsh.

5. Delivery estimates and customer approvals

Naqsh usually aims to provide the first preview link within 2–3 days after the booking is confirmed and all required invitation details and usable files have been received. This is an estimate rather than a guaranteed deadline unless a different deadline is expressly agreed in writing.

Final delivery depends on the scope of work, revision requests, customer response times, technical availability and any additional work agreed. Corrections required because Naqsh introduced an error will be made without treating the correction as a customer-requested redesign.

6. Revisions

The standard service includes three consolidated revision rounds unless the checkout or an accepted quotation states otherwise. A “revision round” means one reasonably organised list of requested changes submitted after reviewing the latest preview.

Additional reasonable revisions may be accommodated at Naqsh’s discretion. Extensive changes, repeated changes to previously approved content, theme changes, redesigns or added features may require an additional fee, which will be disclosed and agreed before that extra work begins.

7. Digital delivery, compatibility and availability

The invitation is delivered digitally through a preview or final web link; no physical product is shipped. You may share the completed invitation normally with guests through WhatsApp, social media, email, messaging services or the invitation link.

Websites may display or behave somewhat differently across browsers, operating systems, screen sizes, accessibility settings, connection speeds and devices. Naqsh will use reasonable care to support commonly used modern browsers and devices, but cannot promise pixel-identical presentation everywhere.

Hosting, networks and third-party services may occasionally be interrupted for maintenance, security incidents or causes outside Naqsh’s reasonable control. We will use reasonable efforts to restore a Naqsh-controlled service and communicate material interruptions where practical.

8. Your licence to the completed invitation

After full payment, and subject to these Terms, Naqsh grants you a limited, non-exclusive, non-transferable licence to access, use and share the completed personalised invitation for the specific event for which it was created. This includes ordinary non-commercial sharing with your guests and keeping reasonable personal archival copies or screenshots.

The licence covers use of the completed invitation as an invitation. It does not include a licence to extract or reuse the underlying template, code, components or creative system in another project, product, template, service or business. A customer may not sell or transfer this licence, although guests and event participants may of course view and share the invitation in the ordinary way.

9. Intellectual property retained by Naqsh

Naqsh Digital owns or lawfully licenses the relevant intellectual property used to provide the service. Subject to customer and third-party rights, this may include original invitation templates, HTML, CSS, JavaScript, PHP or other backend implementation, source code, reusable components, animation systems, interaction logic, design systems, layouts, original artwork, UI elements, template implementations, original written content and proprietary creative assets.

Payment and delivery do not assign or transfer ownership of those underlying materials. Copyright and other intellectual-property rights arise and continue independently of whether browser-delivered files can be viewed, cached or technically accessed.

Naqsh does not claim ownership of customer-supplied photographs or text, licensed fonts, open-source or third-party libraries, stock assets, music, maps, platform services or other third-party content. Such materials remain subject to the rights and licence terms of their respective owners.

Copyright protects original expression and implementation, not broad ideas or generic concepts. Naqsh does not claim exclusive ownership of digital invitations generally, scratch-card interactions generally, countdown timers generally or RSVP systems generally.

10. Prohibited copying and commercial reuse

Except for ordinary use and sharing of your completed invitation under section 8, or where applicable law expressly permits an act that cannot lawfully be restricted, you must not, without Naqsh’s prior written permission:

  • copy, clone, scrape, extract, reproduce, republish or download Naqsh materials for reuse;
  • reverse engineer, decompile or attempt to reconstruct source code or implementation where such restriction is legally permitted;
  • redistribute, sublicense, resell or commercially exploit a Naqsh template, design, source file or component;
  • modify Naqsh materials for resale or create derivative commercial templates from them;
  • use Naqsh code, designs or template implementations as the foundation of another digital-invitation service, competing product or business; or
  • remove or alter copyright notices, credits, attribution, ownership identifiers, embedded marks or proprietary references.

Changing colours, images, names, filenames, class names, text, variable names, decorative elements or minor portions of code does not by itself make a substantially copied work original, cure an unauthorised use or transfer ownership.

Normal temporary browser caching and technical copies required merely to view a demo or a completed invitation are not prohibited by this section.

11. Public demos and access to files

A public demo is provided so prospective customers can evaluate a theme. Viewing a demo, using View Source or developer tools, or otherwise being able to access browser-delivered files does not grant a licence to reuse those files or place them in the public domain.

Removing Naqsh credit or modifying copied files does not create ownership or authorisation. More information is available in our Copyright & Intellectual Property Notice.

12. Portfolio permission

Portfolio permission is optional and is not a condition of booking. Naqsh will not treat ordinary booking consent as permission to advertise using your photographs or completed invitation. If permission is granted, its withdrawal and any limits on removal are explained in the Privacy Notice.

13. Third-party services, links and content

An invitation may link to or use third-party services such as payment processing, hosting, maps, fonts, music, social networks, messaging platforms or email delivery. Those services are controlled by their providers and may have their own terms, privacy practices, availability limits and geographic restrictions.

Naqsh is not responsible for the accuracy or continuing availability of a third-party map, venue listing, link or platform, but will reasonably assist with correcting customer-supplied links within the agreed revision scope.

14. Cancellations and refunds

Cancellations, duplicate or incorrect payments, delays and refunds are governed by the Cancellation and Refund Policy, which forms part of these Terms. Nothing in these Terms limits a non-excludable right or remedy available under applicable consumer law.

15. Events outside reasonable control and reasonable limits

Neither party will be responsible for a delay caused by events outside its reasonable control, including serious network or hosting outages, natural disasters, government action, civil disturbance, widespread service failures or other force-majeure events. The affected party should communicate the delay where reasonably possible, and both parties should try to minimise its effect.

Naqsh remains responsible for providing the service with reasonable care. To the extent permitted by applicable law, liability connected with a particular booking will not exceed the amount actually paid for that booking. This limit does not apply where liability cannot lawfully be excluded or limited.

16. Protection and enforcement

Where Naqsh reasonably believes its intellectual property is being infringed, it may, where legally appropriate, preserve technical and documentary evidence; contact the person responsible, hosting providers, domain registrars, social-media platforms or infrastructure and CDN providers; submit copyright or infringement complaints; request takedown or removal; and seek injunctions, damages, accounts of profits or other remedies available under applicable law.

Any action will depend on the facts, available rights, platform procedures and applicable law. This clause does not claim a guaranteed outcome or restrict lawful exceptions, independent creation or legitimate customer use.

17. Contact, complaints and governing law

Questions or complaints may be sent through our Contact Us page or by email to contact.naqshdigital@gmail.com. We aim to acknowledge complaints within 48 hours and resolve them within one month where reasonably possible.

These Terms are governed by the laws of India. Subject to mandatory consumer-protection rights and applicable jurisdiction rules, disputes will be handled by the competent courts or consumer forums in Chennai, Tamil Nadu.
